By accessing or using the Site, creating an account, or placing an order, you agree to be bound by these Terms and all policies incorporated by reference, including our Privacy Policy and Shipping & Returns Policy.

1. About Boat Engine LLC

Boat Engine LLC is a New York-based authorized marine dealer and service center offering new outboard motors, marine accessories, parts, and professional service. We are an authorized dealer for Yamaha, Mercury, Suzuki, Tohatsu, Honda, Torqeedo, and Seakeeper, and hold the Yamaha Marine Service Pro Elite certification — the highest Yamaha dealership credential available in New York.

We sell products to consumers and businesses in the United States and internationally. These Terms govern all transactions, interactions, and use of our Site regardless of where you are located.

2. Eligibility and Account Registration

2.1 Age Requirement

You must be at least 18 years of age to use this Site, create an account, or place an order. By using the Site, you represent and warrant that you are 18 years of age or older. If you are under 18, you may only use the Site under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

2.2 Account Registration

You may be required to create an account to access certain features of the Site, including order history, service scheduling, and saved addresses. When creating an account, you agree to:

  • Provide accurate, current, and complete registration information
  • Maintain and promptly update your account information to keep it accurate
  • Keep your password confidential and not share it with any third party

We reserve the right to terminate or suspend any account at our discretion, including accounts that provide inaccurate information, violate these Terms, or engage in fraudulent activity.

If you are placing an order or using the Site on behalf of a business or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and “you” shall refer to that entity.

3. Products and Pricing

3.1 Product Descriptions

We make every effort to accurately describe the products listed on our Site, including specifications, horsepower ratings, dimensions, weights, compatibility, and features. However, we do not warrant that product descriptions, images, specifications, pricing, or other content on the Site is complete, accurate, reliable, current, or error-free. Product specifications provided by manufacturers are subject to change without notice.

Images of products are for illustrative purposes only. Actual products may vary slightly from images shown. Color representations may differ depending on your device’s display settings.

3.2 Pricing

All prices displayed on the Site are in U.S. Dollars (USD) unless otherwise stated. Prices are subject to change at any time without notice prior to your order being placed and confirmed. We are not obligated to honor pricing errors — if a product is listed at an incorrect price due to a typographical error or system error, we reserve the right to cancel the order and refund any amount charged, even after an order confirmation has been sent.

Prices shown on the Site do not include:

  • Applicable sales tax (calculated and added at checkout based on your delivery address)
  • Shipping and freight charges (calculated at checkout or quoted separately for large items)
  • Import duties, customs fees, and taxes for international orders (payable by the recipient)
  • Installation charges (quoted separately for service appointments)

3.3 Sales Tax

Boat Engine LLC collects sales tax on orders shipped to states where we have nexus or are required to collect tax under applicable law, including New York. Tax rates are calculated based on the ship-to address. Tax-exempt customers must provide a valid exemption certificate prior to placing their order — please contact us at (415) 448-6583 before ordering.

3.4 Product Availability

Product availability is not guaranteed. Inventory levels on our Site are updated regularly but may not reflect real-time stock. If a product you order becomes unavailable after your order is placed, we will notify you promptly and offer you the choice of a backorder, an alternative product, or a full refund. We are not liable for any damages resulting from product unavailability.

3.5 Authorized Dealer Compliance

As an authorized dealer for Yamaha, Mercury, Suzuki, Tohatsu, Honda, Torqeedo, and Seakeeper, we are bound by dealer agreements with each manufacturer. These agreements may restrict certain pricing practices, geographic sales limitations, or promotional activities. We comply fully with all manufacturer dealer policies. Purchases made through Boat Engine LLC include full manufacturer warranty coverage and factory-authorized support.

4. Orders and Payment

4.1 Placing an Order

When you place an order through our Site or by phone, you are making an offer to purchase the specified products at the displayed price. An order confirmation email does not constitute acceptance of your order — acceptance occurs when we ship the item(s) and send a shipping confirmation. We reserve the right to refuse or cancel any order at our discretion, including orders that appear to be placed for resale in violation of manufacturer dealer policies, orders with suspected fraudulent payment information, or orders that cannot be fulfilled due to pricing errors or inventory limitations.

4.2 Payment Methods

We accept the following payment methods:

  • Major credit and debit cards (Visa, Mastercard, American Express, Discover)
  • PayPal
  • Bank wire transfer (for large orders — contact us for wire instructions)
  • Financing through approved third-party financing partners (subject to credit approval)

Payment is processed at the time of order placement. All transactions are processed through secure, PCI-compliant payment processors. We do not store full credit card numbers on our servers.

4.3 Order Cancellations

You may request cancellation of an order before it has been processed and shipped. Once an order has shipped, the standard return process applies. Special orders — items not normally stocked that are ordered specifically for you — cannot be cancelled once confirmed with the manufacturer or supplier. 4.4 Fraud Prevention

We reserve the right to verify payment information and the identity of the cardholder for any order. We may request additional verification documents for large orders or orders shipped to an address different from the billing address. Orders that fail verification may be cancelled and refunded. We report confirmed fraud to relevant law enforcement authorities.

5. Shipping and Delivery

All shipping terms, including domestic and international shipping, freight delivery, transit times, damage claims, and lost shipment procedures, are governed by our Shipping & Returns Policy, which is incorporated into these Terms by reference.

Risk of loss and title for products purchased from Boat Engine LLC passes to the buyer upon delivery of the item(s) to the carrier. Once a shipment is in the carrier’s possession, the carrier assumes responsibility for delivery. We will assist customers in filing carrier claims for lost or damaged shipments but are not liable for carrier performance.

6. Returns, Refunds, and Warranties

All return, refund, exchange, and warranty terms are governed by our Shipping & Returns Policy, which is incorporated into these Terms by reference.

Manufacturer warranties are provided by the respective manufacturers (Yamaha, Mercury, Suzuki, Tohatsu, Honda, Torqeedo, Seakeeper) and are separate from any rights you may have under applicable consumer protection law. Boat Engine LLC, as an authorized service dealer for all brands we carry, will facilitate warranty service on your behalf.

7. Use of the Site

7.1 Permitted Use

You may use the Site for lawful purposes only, including browsing products, placing orders, scheduling service, and contacting us. You agree to use the Site in a manner consistent with all applicable federal, state, and local laws and regulations.

7.2 Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful, fraudulent, or unauthorized purpose
  • Attempt to gain unauthorized access to any portion of the Site, our servers, or any system or network connected to the Site
  • Transmit any viruses, malware, or other harmful code through the Site

We reserve the right to terminate your access to the Site immediately and without notice for any violation of these prohibited conduct provisions.

7.3 User-Submitted Content

If you submit reviews, testimonials, comments, photos, or other content to our Site (“User Content”), you grant Boat Engine LLC a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, publish, and display such User Content in connection with our business and marketing. You represent and warrant that you own or have the rights to submit such content and that it does not infringe any third-party rights. We reserve the right to remove any User Content at our discretion.

8. Intellectual Property

8.1 Our Content

All content on the Site — including but not limited to text, product descriptions, photographs, graphics, logos, icons, audio and video clips, digital downloads, data compilations, and software — is the property of Boat Engine LLC or its content suppliers and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

The Boat Engine LLC name, logo, and all related marks are trademarks of Boat Engine LLC. You may not use our trademarks without our prior written consent.

8.2 Manufacturer Trademarks

References to Yamaha, Mercury, Suzuki, Tohatsu, Honda, Torqeedo, and Seakeeper on this Site are for product identification and dealer authorization purposes only. These brand names, logos, and trademarks are the property of their respective owners. Boat Engine LLC is an authorized dealer for these brands but is independent of each manufacturer.

8.3 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to reproduce, modify, distribute, publicly display, or create derivative works of any Site content without our express written permission.

9. Third-Party Links and Services

The Site may contain links to third-party websites, including manufacturer websites, financing partners, shipping carriers, and social media platforms. These links are provided for your convenience only. We do not endorse, control, or assume responsibility for the content, privacy practices, or accuracy of any third-party websites. Third-party services embedded in our Site (including Google Analytics, Google Maps, Meta Pixel, and YouTube) are governed by the respective third parties’ terms of service and privacy policies.

10. Service Appointments and In-Store Transactions

10.1 Service Scheduling

Service appointments made through the Site, by phone, or by email are subject to availability and confirmation by our service team. A confirmed appointment is not a guarantee of a specific completion date — completion times depend on the nature of the service, parts availability, and our service queue at the time of drop-off.

10.2 Service Estimates and Authorizations

Before commencing any repair or maintenance work, we will provide you with a written estimate of labor and parts costs. No work will begin without your explicit authorization. If additional work is found to be necessary during service, we will contact you for authorization before proceeding. You are not obligated to authorize additional work.

10.3 Engine Drop-Off and Storage

Engines and equipment left for service must be claimed within 30 days of notification that service is complete. Equipment left beyond 30 days without prior arrangement may be subject to a storage fee of up to $25 per day. We are not responsible for loss or damage to equipment left beyond 60 days after service completion notification.

10.4 Diagnostic Fees

A diagnostic fee may apply for troubleshooting and diagnostic services. This fee will be disclosed to you before work begins. If you authorize the recommended repair following diagnosis, the diagnostic fee may be applied toward the cost of the repair at our discretion.

11. Disclaimers and Limitation of Liability

11.1 Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOAT ENGINE LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT ON THE SITE.

This disclaimer does not affect your statutory rights as a consumer, which vary by jurisdiction and cannot be excluded by contract.

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BOAT ENGINE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH:

  • Your use of or inability to use the Site or our products and services
  • Any errors, omissions, or inaccuracies in the content of the Site
  • Unauthorized access to or alteration of your data or transmissions
  • Any third-party conduct or content on the Site
  • Any other matter relating to the Site or our products and services

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BOAT ENGINE LLC IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, THE LIMITATIONS ABOVE APPLY ONLY TO THE FULLEST EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS LIMITS OUR LIABILITY FOR FRAUD, GROSS NEGLIGENCE, OR INTENTIONAL MISCONDUCT.

11.3 Marine Safety Disclaimer

Outboard motors and marine products are powerful equipment that must be installed, operated, and maintained by qualified individuals following all applicable safety guidelines, manufacturer instructions, U.S. Coast Guard regulations, and state boating laws. Boat Engine LLC is not responsible for any injury, death, property damage, or loss arising from the improper installation, misuse, operation, or maintenance of any product purchased from us. Always consult a certified marine technician for installation and follow all manufacturer safety instructions.

12. Indemnification

You agree to defend, indemnify, and hold harmless Boat Engine LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • Your use of the Site or our products and services
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights or privacy rights
  • Any content you submit to the Site
  • Any false or inaccurate information you provide to us

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. To the extent applicable, federal law of the United States also governs these Terms.

13.2 Informal Resolution

Before initiating any formal legal proceeding, you agree to contact us first at legal@boatengine.net to describe the dispute and attempt to resolve it informally. We will attempt to respond within 15 business days. Most customer concerns can be resolved quickly and informally.

13.3 Binding Arbitration

If a dispute cannot be resolved informally, any controversy or claim arising out of or relating to these Terms or your use of the Site or our products shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with the arbitration conducted in New York, New York. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: You and Boat Engine LLC agree that each party may only bring claims against the other in an individual capacity and not as a plaintiff or class member in any purported class action, class arbitration, or representative proceeding. The arbitrator may not consolidate more than one person’s claims.

13.4 Exceptions to Arbitration

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction in New York to protect intellectual property rights or to prevent imminent harm. Nothing in this section prevents either party from filing a claim in small claims court for disputes within that court’s jurisdiction.

13.5 Jurisdiction and Venue

For any disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction and venue of the state and federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts.

14. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.

15. Digital Communications and Electronic Records

By using our Site and placing orders, you consent to receive communications from us electronically, including order confirmations, shipping notifications, service updates, and other transactional communications via email or SMS. You agree that electronic communications satisfy any legal requirement that such communications be in writing. You may opt out of marketing communications at any time, but you cannot opt out of transactional communications related to active orders or service appointments.

16. Force Majeure

Boat Engine LLC shall not be liable for any delay or failure to perform our obligations under these Terms where such delay or failure results from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, floods, fires, earthquakes, pandemics, war, terrorism, civil unrest, labor strikes, government actions, embargoes, port closures, carrier disruptions, manufacturer delays, supply chain disruptions, or internet or telecommunications outages.

In such circumstances, we will notify you as soon as reasonably practicable and resume performance as soon as the force majeure event is resolved. If a force majeure event prevents us from fulfilling your order for more than 60 days, either party may cancel the order and you will receive a full refund of any amount paid.

17. Modifications to These Terms

Boat Engine LLC reserves the right to modify these Terms at any time. When we make material changes, we will:

  • Update the “Last Updated” date at the top of this page
  • Post a notice on our Site homepage for 30 days following any significant change
  • Where required by law, notify registered account holders by email

Your continued use of the Site after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site. We encourage you to review these Terms periodically.

18. Severability and Waiver

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of these Terms shall continue in full force and effect.

Our failure to enforce any provision of these Terms on any occasion shall not constitute a waiver of that provision or of our right to enforce it on any future occasion.

19. Entire Agreement

These Terms, together with our Privacy Policy and Shipping & Returns Policy, constitute the entire agreement between you and Boat Engine LLC with respect to your use of the Site and purchase of our products and services, and supersede all prior agreements, representations, and understandings of any kind relating to the same subject matter.
